Terms of Use

These Terms of Use (“Terms”) govern your use of StageWhip (the “Service”), operated by OpsEngine (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

StageWhip uses artificial intelligence to edit real estate photographs you upload: adding virtual furniture and decor, modifying finishes, and similar changes, at your direction. AI-generated results are illustrative renderings, not photographs of real conditions. You are solely responsible for how you use the results, including compliance with the rules of any MLS, listing service, brokerage, or advertising regulation that applies to you, such as requirements to disclose that an image is virtually staged. The Service provides a disclosure watermark feature; it is your responsibility to use wording and placement that satisfy your local rules.

2. Your Content and Authority to Use It

By uploading a photograph or other content to the Service, you represent and warrant that you own the content or hold all rights, licenses, and permissions necessary to upload it and to have it modified, including any permission required from the photographer or copyright holder. Professional real estate photography is typically protected by copyright, and a license to use a photo for listing purposes does not always include the right to create derivative works. It is your responsibility to confirm you have that right before uploading.

3. Copyright Infringement

We respect the intellectual property rights of others and expect our users to do the same. If we determine, in our sole discretion, that content you uploaded infringes another party’s copyright or other rights, or if we receive a credible infringement claim regarding your account, we may suspend or terminate your account without refund of any subscription fees or unused credits. Repeat infringement will result in termination.

4. Indemnification

You agree to indemnify, defend, and hold harmless OpsEngine, StageWhip, and their owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) content you upload to the Service, including any claim that it infringes a third party’s copyright, trademark, or other rights; (b) your use of images produced by the Service, including any claim arising from real estate advertising or disclosure rules; and (c) your violation of these Terms.

5. Privacy and Your Data

We collect the information needed to operate the Service: your account details (name, email), billing information (processed by Stripe; we never store card numbers), the photos you upload, and the images the Service generates. We use this information only to provide the Service to you:

• We do not sell or resell your personal information to anyone.
• Photos you upload are used solely to produce and deliver your results. We do not reuse them for any other purpose: not for AI model training, not for marketing, and not for delivery to anyone other than you, unless you give us separate written permission.
• If you opted in to product updates, we may email you about the Service; you can opt out at any time from your account page or an email’s unsubscribe link.
• Deleting a staging from your history permanently deletes the stored images. Deleted images are unrecoverable.

6. Credits, Subscriptions, and Billing

Staging operations consume credits. Subscription plans include a monthly credit allowance; unused credits roll over while your subscription remains active. If your subscription is cancelled, all remaining credits, including rolled-over and purchased top-up credits, expire at cancellation and are not refunded. Credits have no cash value and are non-transferable. If a staging operation fails, the credits for the failed portion are automatically returned. Except as required by law, fees are non-refundable.

7. Acceptable Use

You may not use the Service to create deceptive or fraudulent real estate imagery, to misrepresent the physical condition of a property in a manner prohibited by applicable law or listing rules, or to process images you have no right to use. We may refuse or remove content and suspend accounts that violate this section.

8. Disclaimers and Limitation of Liability

The Service is provided “as is” without warranties of any kind, express or implied. AI output can contain errors or artifacts; review results before publishing them. To the maximum extent permitted by law, our total liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months before the claim arose, and we are not liable for indirect, incidental, or consequential damages.

9. General

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. We may update these Terms; material changes will be posted on this page with a new effective date, and continued use of the Service after changes take effect constitutes acceptance. If any provision of these Terms is found unenforceable, the remainder stays in effect.
